The solution

Provided that the lease contains a forfeiture clause giving the landlord the right to terminate the lease and “re-enter” the premises following a breach, the tenants lease agreement can be forfeited on several grounds without going to the courts:

• rent arrears outstanding after a specified period
• the tenant is made bankrupt
• the tenant goes into administration, liquidation or appointments a receiver
• a breach of a covenant

Forfeiture of a lease (or Peaceable Possession) can be carried out by the landlord instructing a Certificated Bailiff.

This is an effective method if the bailiff can not levy distress because either they can not gain entry, or there are insufficient goods to seize, or all goods belong to third parties.

Working Principals

Landlords of commercial property can recover rent arrears by using a Certificated Bailiff without having to go through the court process. You simply complete and sign a Rent Warrant under the Distress for Rent Act without any notice to the Debtor providing the following conditions are met anywhere in England and Wales:

1. There must be an existing tenancy agreement or a previous one in place that has expired
2. The rent must be one day overdue or more
3. The landlord must not have issued any proceedings regarding this debt
4. You must issue a rent warrant using the forms we provide
5. Distress can only be executed at the property for which the rent is in arrears, not the tenants home. Only goods which are not protected by law may be seized by the bailiff.
